Terms of Use.

What changed on October 4, 2026:

• Deleting your account: We corrected the steps. In the app, go to the Account tab, then Account Details, then Delete Account or Take a Break. You can also delete your account at gaydarapp.com/delete-account. (Section 8)
• Refunds: Apple or Google handles refunds for App Store and Google Play Store purchases under their own rules. For web purchases, contact support. We handle each request case by case and as the law requires. (Section 4)
• Free trials: We now describe both kinds. A trial through Apple or Google turns into a paid subscription unless you cancel before it ends. A Gaydar trial needs no payment method and ends on its own. (Section 4)
• Ads: The Free tier may include ads, and Gaydar Pro removes them. We also corrected the path to the Do Not Sell or Share control. (Section 10A)
• Your content: Venue suggestions, edits and claims on IRL now count as your User Content. (Section 6)
• Small fixes: The age rule now reads "18 or older", and we fixed a typo. (Sections 2 and 4)

Please read these Terms carefully. These Terms include a mandatory arbitration agreement and a class-action waiver (Section 17) that affect your legal rights. You may opt out of arbitration as described below. By using the Service, you agree to these Terms and our Privacy Policy.

These Terms of Use ("Terms") form a binding agreement between you and Gaydar Inc., a Delaware corporation with its principal place of business at 421 8th Avenue, #9227, New York, NY 10116, United States ("Gaydar," "we," "us," or "our"), governing your use of the Gaydar mobile application and any related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You may use Gaydar only if all of the following are true:

• You are 18 or older.
• You have the legal capacity to enter into a binding contract in your jurisdiction.
• You are not barred from using the Service under the laws of the United States or any other applicable jurisdiction (including OFAC sanctions lists).
• You have not previously been banned or removed from Gaydar.
• You are not a registered sex offender of any kind.

We may require identity or age verification at any time and may suspend or terminate your account if you fail or refuse to complete it.

2.1 Age Verification Disclaimer

We rely on your representation that you are 18 or older when you create an account. We do not perform independent age verification at signup. If you are under 18 and access Gaydar by misrepresenting your age, you violate these Terms and may face legal consequences. Parents and guardians who discover a minor using Gaydar should contact trust@gaydarapp.com immediately so we can remove the account. Gaydar is not responsible for ages that are misrepresented by users, but we will act promptly on verified reports of underage use.

If we receive a report that you may be under 18, we may lock your account immediately and require you to verify your age with a valid, unexpired government-issued photo ID before restoring access. Automated systems, with human review where needed, read the ID to confirm your age; the handling of that ID is described in Section 10.1 of our Privacy Policy. Accounts confirmed to belong to people under 18 are permanently removed.

• Phone-number login. Accounts are created using your mobile phone number, verified via SMS one-time code. You are responsible for maintaining access to that number.
• Account security. You are responsible for all activity on your account. Notify us immediately at trust@gaydarapp.com if you suspect unauthorized access.
• One account per person. You may not create multiple accounts, sell your account, or allow others to use your account.
• Accurate information. Your profile information must be truthful and must represent you. Impersonation, catfishing, and fake profiles are prohibited.

By providing your mobile phone number and tapping "Continue" on the Gaydar phone verification screen, you consent to receive one-time passcode (OTP) text messages from Gaydar for account verification purposes.

• Program name. Gaydar OTP Verification.
• Program description. Gaydar sends one-time passcodes via SMS to verify phone number ownership during signup and login. This is a transactional service, not a marketing program.
• Message frequency. Messages are sent only when you request a verification code (for example, signing up or logging in). You will not receive recurring or marketing messages through this program.
• Message and data rates. Message and data rates may apply based on your mobile carrier plan. Gaydar does not charge for SMS verification, but your carrier may.
• Supported carriers. All major US carriers (AT&T, T-Mobile, Verizon, and others) and international carriers where our SMS provider can deliver.
• HELP. Reply HELP to any message to receive support information. You can also email support@gaydarapp.com for help.
• STOP (opt-out). Reply STOP to any message to opt out of future SMS from Gaydar. After opting out, you will not be able to log in via SMS verification until you re-enable it by contacting support.
• Support contact. For questions or issues with SMS delivery, email support@gaydarapp.com.

Gaydar does not sell, share, or use your phone number for marketing purposes. See our Privacy Policy for full data handling details.

Gaydar offers a paid subscription tier (Gaydar Pro) and consumable or non-consumable in-app purchases, available through the Apple App Store, Google Play Store, and our web-based platform.

• Payment authorization. For purchases through the Apple App Store or Google Play Store, payment is charged to your Apple ID or Google account at confirmation of purchase. For web-based purchases, payment is processed through our third-party payment processor.
• Auto-renewal. Subscriptions automatically renew at the then-current price for the same term unless canceled at least 24 hours before the end of the current period.
• Managing your subscription.
  • For Apple App Store purchases: Manage or cancel in iOS Settings → [your name] → Subscriptions.
  • For Google Play Store purchases: Manage or cancel in the Google Play Store app or at play.google.com.
  • For web-based purchases: Manage or cancel through your account settings on our website.
  • Deleting the app from your device does not cancel your subscription.
• Free trials. We may offer two kinds of free trial. A trial offered through the Apple App Store or Google Play Store converts to a paid subscription at the end of the trial unless canceled at least 24 hours before the trial ends. A Gaydar trial needs no payment method and ends on its own, so nothing is charged when it ends. Each user is generally entitled to only one free trial.
• Price changes. We may change subscription prices. Material changes will be communicated in advance and will not apply to your current billing period.
• Refunds. Except where required by law, payments are non-refundable. Apple or Google handles refunds for App Store and Play Store purchases under their own rules, so refund requests for those purchases must be directed to Apple or Google. For web-based purchases, contact support@gaydarapp.com. We handle each request case by case and as the law requires.
• Payment data. For App Store and Play Store purchases, we do not receive or store your credit-card, debit-card, or bank-account information. Apple or Google is the merchant of record. For web-based purchases, payment information is processed securely by our third-party payment processor; we do not store your full payment card details.

California residents (automatic-renewal disclosure): By subscribing, you authorize Gaydar (via Apple, Google, or our payment processor) to charge your payment method automatically at each renewal until you cancel as described above.

You agree NOT to use the Service to:

1. Upload, send, or request sexual content involving minors or any content depicting a person who is or appears to be under 18. Such content is reported to NCMEC and law enforcement.
2. Upload or share non-consensual intimate imagery (so-called "revenge porn") or images of any person without their consent.
3. Engage in harassment, threats, hate speech, or violence against any person or group, including based on sexual orientation, gender identity, race, ethnicity, religion, disability, or HIV status.
4. Engage in commercial solicitation, escort work, sex work, drug sales, weapon sales, or any illegal transaction. As a Verified Creator, listing the creator accounts you have verified with us, naming the platforms of those accounts, and inviting people to subscribe to them, in the way Section 6.3 allows, is not commercial solicitation. Selling content directly, or asking anyone to buy, tip or pay, on Gaydar or through a payment app, is. So is naming or promoting a paid-content or creator account, or asking people to subscribe to one, when you are not a Verified Creator. Everything else in this rule applies to Verified Creators.
5. Impersonate another person, create fake profiles, catfish, or misrepresent your identity, age, or affiliation.
6. Disclose another user's private information (including real name, location, phone number, workplace, sexual orientation, gender identity, or HIV status) without their consent ("doxing" / outing).
7. Use bots, scrapers, automation tools, or reverse-engineering to access, copy, or extract data from the Service, or to artificially inflate metrics.
8. Attempt to circumvent rate limits, moderation systems, age gates, geographic restrictions, or any security mechanism.
9. Interfere with or disrupt the Service or any server, network, or infrastructure used to provide it.
10. Upload malware, exploits, or code designed to damage or gain unauthorized access.
11. Use the Service to facilitate human trafficking, exploitation, or solicitation of minors.
12. Send unsolicited commercial communications (spam) to other users.
13. Use the Service where prohibited by local law (including, where applicable, laws concerning same-sex relationships — we disclaim responsibility for your compliance with such laws).
14. Misuse the Discover feature to deceive other users for fraudulent, criminal, or harassing purposes. Discover lets you browse profiles in a place other than your real location; it must not be used to evade a ban or defraud.
15. Share another user's location pin or location-in-chat message outside of Gaydar without their consent.
16. Upload, post, or share content that infringes any copyright, trademark, or other intellectual-property right of any person or entity. You must own or have the necessary rights to everything you upload. See Section 7.1 for how rights holders can report infringement; repeat infringers are terminated.

Violations may result in content removal, warnings, temporary suspension, permanent ban, forfeiture of paid subscription time, and reporting to law enforcement.

Gaydar is a user-generated-content service. We take user safety seriously and maintain the following commitments to every user of the Service:

• Zero tolerance for objectionable content. Content that violates Section 5 — including, without limitation, sexual content involving minors, non-consensual intimate imagery, hate speech, threats, harassment, doxing, impersonation, spam, malware, and content depicting human trafficking or sexual exploitation — has no place on Gaydar and is prohibited regardless of who posts it or who is depicted.
• Automated content filtering. Every profile photo, video, voice note, and chat message you upload is automatically screened by third-party content-moderation services before it becomes visible to other users or, in the case of chat, when it is sent. Material classified as sexual involving minors, illicit, or violent is blocked at the source. Selfie verification additionally runs liveness and contour checks to reduce impersonation.
• In-app reporting. Every profile, every chat, and every match exposes a one-tap Report affordance that opens a structured report form with eight categories, including a dedicated "Suspected to be under 18 years old" category that routes directly to our Trust & Safety review queue and, where applicable, to NCMEC and law enforcement per 18 U.S.C. § 2258A.
• Timely response to reports. We commit to acknowledging and acting on reports of objectionable content within 24 hours of submission. Reports flagged as urgent (suspected CSAM, threats of violence, suspected human trafficking) are escalated immediately and reviewed around the clock. We may take action including removing content, restricting features, suspending accounts, banning users, and reporting to law enforcement.
• User blocking. Every Report flow also exposes a Block action. Blocking a user is one tap and removes that user from your feed, your matches, your messages, and any other surface where they could contact you. Blocks are immediate and persistent. You may manage and unblock from Settings → Blocked Users at any time.
• Account termination for repeat or severe violators. Users who repeatedly violate Section 5, or who commit a single severe violation (CSAM, doxing of a real person, credible threats of violence, human trafficking), are permanently banned from the Service, forfeit any paid subscription time, and are subject to applicable law-enforcement reporting.
• Public contact for safety concerns. You may reach our Trust & Safety team at trust@gaydarapp.com at any time, including to escalate a report, to report a user we missed, or to request appeal of a moderation decision.

These commitments are an integral part of these Terms and are designed to comply with App Store Review Guideline 1.2 and Google Play Developer Program Policies on user-generated content.

"User Content" means any content you upload, post, or transmit through Gaydar: photos, videos, voice notes, bio text, messages, reactions, reports, appeals, profile attributes, and venue suggestions, edits and claims on IRL (a space you recommend, an edit you suggest to a venue, or a business you claim, with any evidence you send).

• You retain ownership of your User Content.
• License to Gaydar. You grant Gaydar a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for format/resizing purposes), create derivative works of (e.g., thumbnails, blurhash previews, transcriptions of voice notes), publicly display, and distribute your User Content solely for the purpose of operating, securing, improving, and promoting the Service. This license ends when you delete the content or your account, except as described in Section 8 (Termination) and for residual backup copies as described in our Privacy Policy.
• No model training. We do not license your User Content to third parties to train generative AI models, and we do not use it to train such models ourselves.
• Responsibility. You represent that you have all necessary rights to the User Content you upload and that it does not violate law or these Terms.

6.1 Selfie Verification

If you use the "Verified" badge feature, you voluntarily submit a selfie. That image is processed to confirm it depicts a live person matching your profile photos. You may remove verification and delete the selfie at any time in app settings.

6.2 Automated Moderation

All uploaded images, video, and voice notes are automatically scanned using third-party content moderation services for safety and accessibility purposes. We may remove content and suspend accounts based on automated or human review. Confirmed CSAM is reported to NCMEC and law enforcement in accordance with 18 U.S.C. § 2258A.

6.3 Verified Creator Program

The Verified Creator program is optional and currently free. We may charge for some or all creator features in the future and will tell you before any charge applies. If you become a Verified Creator while the program is free, we will not charge you for the creator features you have at that time, for as long as your creator account remains in good standing, including after we start charging new creators.

Eligibility. To become a Verified Creator you must be 18 or older, hold a current verified selfie, pass an automated check of a government ID, with human review where needed, and show that you control each creator account you link by placing a one-time code in that account's bio. We check the code automatically where the site lets us read your public bio; otherwise a person on our team checks it. A person on our team decides every application. We may approve or decline any application at our discretion, including where we cannot confirm the information you submit or you break these Terms or the Community Guidelines. How we handle your ID is described in Section 10.2 of our Privacy Policy.

Your promises. You confirm that the information and ID you submit are yours and are accurate, that you own or are authorized to control every account you link, and that you will keep that information current. You give us permission to display your linked account names on your profile.

What the badge means. The Verified Creator badge means the creator passed Gaydar's creator checks: a verified selfie, an ID matched to their profile photos, and proof they control the accounts they list. Gaydar does not review their content. The badge is not a background check, and it is not an endorsement of any person, their content, their accounts, or anything they offer. Other platforms named in Creator links are not affiliated with Gaydar and do not endorse it.

Creator links. Creator links are hidden by default. A member sees them only after turning creator links on in their account on gaydarapp.com, and tapping a link first shows a screen saying the link opens an adult website for people 18 and over.

Removing Verified Creator status. We may remove your badge, your Creator links and your collaboration settings at any time, including where we cannot confirm the information you submitted or you break these Terms or the Community Guidelines. If we remove your status, you may apply again only if our team allows it. Your badge, Creator links and collaboration settings also stop showing while your verified selfie is not current or your account is not active. You may leave the program at any time in Creator Profile on your Account tab.

Collaboration between members. Gaydar is a place to meet. We are not a party to any arrangement between members. We do not produce, commission, host, manage, or distribute content that members create together, and we do not process payments between members. If you create content with another person, you alone are responsible for confirming their age and identity, obtaining their written consent, keeping any records the law requires, and following the rules of the platforms where you publish.

Open to collabs and introduction requests. A Verified Creator may say they are open to collabs and choose the kinds of projects that interest them. A Verified Creator may send a limited number of introduction requests each day to members who have turned on "comfortable doing content creation". A request names only the kinds of projects; it has no message. Nothing happens unless the member accepts, and a chat opens only then. Either member can decline, stop talking, or block the other at any time. After a request is declined, expires or is cancelled, the same creator cannot send that member another request for 30 days.

Promoting your accounts. As a Verified Creator you may name the platforms of the accounts you have verified with us and invite people to subscribe to those accounts, in your bio and in chat. You may not name or promote an account you have not verified with us, sell content directly, or send the same pitch to many members.

Members who are not Verified Creators. If you are not a Verified Creator and you name or promote a paid-content or creator account, or ask people to subscribe to one, in your bio or in a message, we block the bio or the message and ask you to upgrade to a creator account. Three blocked tries in seven days suspend your account for seven days. A repeat within 60 days keeps the account suspended until our team reviews it. A member who has started a creator application is blocked but not suspended. You can appeal as the Community Guidelines describe.

No payments on Gaydar. You may not request, offer, or negotiate payment through Gaydar. Section 5 applies in full.

"Comfortable doing content creation." Any member with a current verified selfie may turn this preference on. It is off by default, visible only to Verified Creators, and can be turned off at any time; turning it off cancels any requests still waiting. Turning it on is not an agreement to create anything with anyone.

The Service, including all software, graphics, logos, trademarks, text, and look-and-feel, is owned by Gaydar or its licensors and protected by intellectual property laws. Subject to these Terms, Gaydar grants you a limited, non-exclusive, non-transferable, revocable license to install and use the app on a compatible device you own or control, solely for personal, non-commercial use.

You may not (and may not permit anyone else to): copy, modify, distribute, sell, lease, reverse-engineer, decompile, or create derivative works of the Service, except as permitted by law.

7.1 DMCA Notices

If you believe your copyrighted work has been infringed, send a notice to our Designated Agent at dmca@gaydarapp.com (or Gaydar Inc., Attn: DMCA Agent, 421 8th Avenue, #9227, New York, NY 10116, United States) containing the information required by 17 U.S.C. § 512(c)(3). We will respond to valid notices and may terminate repeat infringers.

• By you. You may delete your account at any time (in the app: Account tab → Account Details → Delete Account or Take a Break; or on the web at gaydarapp.com/delete-account). Deletion initiates the process described in the Privacy Policy.
• By us. We may suspend or terminate your account, with or without notice, if you violate these Terms, if required by law, or to protect the Service, our users, or third parties. We may also discontinue the Service or any features at any time.
• Effect. On termination, your license to use the Service ends and we may delete your User Content, subject to retention for legal, safety, fraud-prevention, or dispute-resolution purposes. Sections that by their nature should survive (including Sections 6, 7, 9–18) survive termination.

Gaydar is a platform. It does not conduct criminal background checks on its users. You interact with other users at your own risk.

• Do not send money, gifts, or cryptocurrency to people you have not met in person.
• Be wary of anyone who pressures you, asks for intimate images, claims to be in an emergency, or refuses video calls.
• Meet in public places and tell a friend where you are going.
• Use your own judgment regarding disclosure of sensitive information (including HIV status, gender identity, or precise location).
• A Verified Creator badge means that person passed Gaydar's creator checks: a verified selfie, an ID matched to their profile photos, and proof they control the accounts they list. Gaydar does not review their content. The badge is not a background check and not an endorsement.
• Creator links open websites that Gaydar does not operate. Their content and their terms are their own.

If you experience harm, report it in-app and contact local authorities where appropriate. You may also contact trust@gaydarapp.com.

Gaydar lets you optionally display HIV status, last-tested date, and PrEP use. Such disclosures are for informational, non-medical purposes only and do not constitute medical advice. Consult a licensed healthcare provider for medical questions. Gaydar is not a HIPAA-covered entity.

The Free tier may include ads, and Gaydar Pro removes them. We may display banner, interstitial, native, and rewarded-video ads through third-party advertising partners. On iOS, advertising tracking requires your affirmative consent via the Apple App Tracking Transparency prompt. You can opt out of cross-context behavioral advertising at any time in Account tab → Privacy & Security → "Do Not Sell or Share My Personal Information." We do not share your sensitive personal information (sexual orientation, gender identity, HIV status, or message content) with advertisers. See our Privacy Policy for details.

The Service relies on third-party providers listed in our Privacy Policy (including cloud infrastructure, authentication, AI services, payment processing, and analytics services). Their services are governed by their own terms. We are not responsible for third-party services, and your use of them may be subject to additional terms and fees.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, GAYDAR AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (B) ANY PARTICULAR CONTENT WILL BE AVAILABLE; (C) MATCHES OR INTERACTIONS WILL MEET YOUR EXPECTATIONS; OR (D) THE CONDUCT OF OTHER USERS WILL CONFORM TO THESE TERMS OR THE LAW.

Some jurisdictions do not allow certain warranty exclusions; the above exclusions apply to the fullest extent permitted.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL GAYDAR, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES;
• LOST PROFITS, LOST REVENUE, LOSS OF GOODWILL, LOSS OF DATA, OR LOSS OF USE;
• DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE CONDUCT OF OTHER USERS, INCLUDING OFFLINE INTERACTIONS.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO GAYDAR IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) USD $100.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages; these limitations apply to the fullest extent permitted.

You agree to indemnify, defend, and hold harmless Gaydar and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or relating to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms or any applicable law; or (d) your infringement of any right of another person or entity.

The following terms apply only if you access the Service through the Apple App Store. These terms supplement the Apple App Store's standard "Licensed Application End User License Agreement" ("Apple EULA"):

1. These Terms are between you and Gaydar, not Apple. Apple is not responsible for the app or its content.
2. The license granted in Section 7 is limited to use on Apple-branded devices you own or control and is subject to the Apple EULA.
3. Apple has no obligation to provide maintenance or support for the app.
4. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation.
5. Gaydar, not Apple, is responsible for addressing any claims by you or a third party relating to the app, including product-liability claims, consumer-protection claims, and intellectual-property claims.
6. You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist-supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
7. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

We may modify the Service, add or remove features, or change these Terms at any time. If changes are material, we will notify you (in-app, by push, or by email) and update the "Last Updated" date. Continued use of the Service after the effective date of changes constitutes acceptance. If you do not agree, stop using the Service and delete your account.

Please read carefully. This section affects your legal rights.

17.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by emailing legal@gaydarapp.com with a written description. We will attempt in good faith to resolve the claim within 60 days.

17.2 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute") will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and not in court, except as set out below. The Federal Arbitration Act governs the interpretation and enforcement of this provision. Arbitration will take place in New York County, New York (Manhattan) or via remote proceedings, and judgment on the award may be entered in any court of competent jurisdiction.

17.3 Class-Action Waiver

You and Gaydar each agree that Disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of class proceeding.

17.4 Exceptions

Either party may (a) bring a qualifying claim in small-claims court; (b) seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual-property rights; and (c) in the case of California users, exercise rights under the CCPA/CPRA in accordance with applicable law. Nothing in this Section prevents you from filing a complaint with a governmental agency.

17.5 30-Day Opt-Out

You may opt out of this Section 17 by emailing legal@gaydarapp.com with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. The email must include your account phone number and full name. Opting out will not affect other provisions of these Terms.

17.6 Governing Law; Venue

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. For any Dispute not subject to arbitration, the exclusive venue is the state or federal courts located in New York County, New York (Manhattan), and both parties consent to personal jurisdiction there.

• Entire Agreement. These Terms, together with the Privacy Policy and any supplemental policies we post, constitute the entire agreement between you and Gaydar.
• Severability. If any provision is held unenforceable, the remaining provisions will continue in effect.
• No Waiver. Our failure to enforce any provision is not a waiver.
• Assignment. You may not assign these Terms. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
• Notices to you may be given via in-app notice, push, or email.
• Notices to us must be sent to legal@gaydarapp.com and Gaydar Inc., Attn: Legal, 421 8th Avenue, #9227, New York, NY 10116, United States.
• Export control. You agree to comply with all applicable U.S. and foreign export-control laws.
• Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
